Terms of Service

Welcome to the Service. Please read these Terms of Service carefully before registering or using the Service. By registering, signing in, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.

1. The Service

The Service is an AI model API aggregation and relay platform that forwards your requests, through a unified interface, to third-party large-model providers (including but not limited to OpenAI, Anthropic, Google, xAI, ByteDance / Volcengine, MiniMax and Alibaba Cloud) to deliver chat, image generation and similar capabilities. The Service does not itself produce model content; outputs are generated by the upstream providers. Upstream availability, rate limits and policies may change at any time; we strive for stability but make no absolute guarantee regarding upstream services.

2. Account & Registration

You must provide true and accurate registration information and keep your account, password and API Keys secure. You are solely responsible for any loss arising from your failure to safeguard them, and for all requests made through your account. Reselling, lending, or unauthorized use of accounts or API Keys is prohibited.

3. Billing & Top-ups

The Service uses a prepaid credit model and charges by actual usage (per token / per image, etc.); prices are as stated on the Pricing page. Credits are used to offset usage fees. If you need a refund, please contact us through the contact options under Resources in the site footer; we verify each request individually and handle it case by case. Failed calls caused by the Service or by an upstream provider are never billed, and any credits already deducted for them are refunded in full. We reserve the right to adjust prices and billing rules with prior notice.

4. Acceptable Use

You agree not to use the Service for anything that violates applicable laws or the upstream providers’ policies, including but not limited to generating or distributing illegal, infringing, violent, sexual, fraudulent, malware, hateful or harassing content; infringing others’ intellectual property or privacy; automated abuse, circumventing quotas or security limits, or harming system security. Because the Service provides image and video generation, the following categories are expressly prohibited, whether as input you submit or as output you request, publish or distribute: (a) pornographic or otherwise sexually explicit material, including non-consensual or intimate imagery; (b) content depicting graphic violence, gore or cruelty, or that incites, glorifies or gives instructions for violent acts or terrorism; (c) hate speech, and content that demeans, dehumanises or incites hatred, harassment or discrimination against a person or group on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or any other protected characteristic; (d) child sexual abuse material and any other sexual or sexualised depiction of a minor, whether photographic, generated, edited or stylised — this prohibition is absolute and admits of no artistic, satirical, research or private-use exception, and we will report such material to the competent authorities where required by law; (e) content that depicts a real, identifiable person without that person’s authorisation, or that impersonates a real person or organisation, including deepfakes, face, voice or likeness cloning, forged identity, official or payment documents, and synthetic media presented as a genuine record of real events; and (f) content that infringes the copyright, trade marks, trade secrets or other intellectual property or personality rights of any third party. You are responsible for holding every right and consent necessary for the material you submit and for any output you go on to publish or distribute. We may restrict, suspend or terminate offending accounts without notice and reserve the right to pursue liability. Anyone may report material generated through the Service that they believe breaches this clause by writing to support@nezhagate.com with the link or a screenshot of the material and, where available, the related order, request or account reference; please mark reports concerning child safety in the subject line. Upon receiving such a report, or otherwise becoming aware of a possible violation, we will review the case and may, in proportion to its seriousness, refuse or remove the content, restrict or disable individual features, invalidate the API key concerned, and restrict, suspend or terminate the account, as well as refer the matter to the upstream provider involved or, where legally required, to the competent authorities; we reserve the right to take these steps without prior notice, and we do not undertake to review content proactively or to respond within any particular period. When calling upstream models through the Service, you must also comply with the relevant upstream providers’ terms.

5. Content & Intellectual Property

You are responsible for your input (prompts) and must have the lawful rights to it. The availability, accuracy and ownership of model outputs are governed by the upstream providers’ terms; we make no warranty as to the correctness, legality or fitness of outputs. The website, interface, documentation and related software are our intellectual property and may not be copied, adapted or used commercially without permission.

6. Disclaimer & Limitation of Liability

The Service is provided “as is” and “as available”, without any express or implied warranty of uninterrupted, error-free operation or fitness for your particular purpose. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of or inability to use the Service (including upstream outages, model outputs, or data latency); our aggregate liability to you is capped at the amount you actually paid us in the three months preceding the dispute.

7. Changes & Termination

We may change, suspend or terminate all or part of the Service with prior notice. If you breach these Terms, we may suspend or terminate your access without notice. You may stop using the Service and delete your account at any time.

8. Privacy

Our handling of your personal information is described in the Privacy Policy, which forms part of these Terms.

9. Updates

We may update these Terms from time to time; updates will be posted on this page with the revised date, and material changes will be highlighted appropriately. Your continued use after an update constitutes acceptance of the revised Terms.
